Trademark Dispute: Burger King Fails to Win Case Against Pune Restaurant Sharing Its Name
In a significant legal battle spanning over 13 years, Burger King Corporation has faced a major setback in its lawsuit against a Pune-based eatery sharing its name. The district court in Pune has dismissed the suit filed by the global fast-food giant, marking a notable victory for the local restaurant. The court’s decision, rendered on August 16, concluded that the Pune establishment, also named ‘Burger King,’ had been operational since 1991-92—well before the US chain’s entry into India in 2014.
Burger King Corporation’s lawsuit, initiated in 2011, sought a permanent injunction against the Pune eatery, accusing it of trademark infringement and unfair competition. The American company also demanded monetary damages amounting to Rs 20 lakh. However, the court found that the Pune-based restaurant had been using the ‘Burger King’ name long before the US chain started its operations in India. Judge Sunil Vedpathak stated that the global chain failed to provide evidence of any actual trademark infringement or consumer confusion resulting from the local restaurant’s use of the name.
The court emphasized that the Burger King Corporation’s entry into the Indian market occurred in 2014, while the Pune eatery had already established its brand under the same name decades earlier. The plaintiff’s claims of damage and trademark violation were deemed unsubstantiated due to the lack of concrete evidence proving harm or confusion caused by the local restaurant’s use of the name.
The ruling also highlighted that the Burger King Corporation, despite its extensive global presence and reputation since its founding in 1954, could not prove that the Pune eatery’s use of the ‘Burger King’ name caused any harm to its business or goodwill. As a result, the court denied the request for monetary damages and a permanent injunction.
